The following article was published in the "Payette Independent" (Payette, Idaho) on Thursday, June 8, 1899:10

While the rest of the folks were gone to the circus at Weiser Tuesday, Mrs. R. S. Rutherford, who was taking care of the baby of Mr. and Mrs. Benjamin Rutherford, started out for a ride in a cart.  The horse became frightened, threw them out and the baby received injuries from which it died at midnight, before its father and mother had returned home.  The Rutherford baby was a grandchild of Mrs. John Henshaw of Washoe bottom.

The Child's Grandmother Took It For a Drive While the Parents Were at the Show

Ontario, Ore., June 7 -- While the rest of the folks were gone to the circus at Weiser yesterday Mrs. R. S. Rutherford, wife of a prominent farmer of this valley, undertook to drive her neighbor, Mrs. John Stone, over to the Hulery farm, about three miles distant to see her son, who was working there, taking Benjamin Rutherford's four-old-son, who had been left with his grandmother for the day along with them.  

In going over, near the Elliott place, about three miles west of Ontario, Mrs. Rutherford driving, Mrs. Stone holding the child, the pony they were driving became frightened at a band of horses passing and shied off into the sagebrush, throwing Mrs. Stone and the baby from the cart.  Mrs. Rutherford soon got the pony under control, picked up Mrs. Stone and the child and drove to Brown's hotel in this city, where a doctor was immediately called.  Mrs. Stone was found to have received a sprained wrist, several bad bruises about the face and head and it is feared serious internal injury.  

The child had received injuries which threw it into spasms from which it died about midnight and before its father and mother had returned from the show.  

With the exception of a severe nervous shock, Mrs. Rutherford, grandmother of the child, was uninjured.

On Sep 12 1918 Ben Franklin Rutherford, age 41, registered for the World War I draft in Valley County, Idaho.  He declared he was born Mar 26 1877 and was then residing in Ontario, Malheur County, Oregon where was employed in logging and rodeo.  He declared his nearest relative was Daisy V. Rutherford of Ontario, Oregon.  He was recorded as medium height, medium build, brown eyes, auburn hair.9

Daisy Viola Henshaw died Dec 11 1926, at her home, San Pedro, Los Angeles County, California; age 46.13  (Dec 10 1926).6  

Daisy's obituary was published in the "Payette Enterprise" (Payette, Idaho) on December 23, 1926:6

MRS. BEN RUTHERFORD DIES
AT HER HOME IN CALIFORNIA

Mrs. Ben Rutherford whose serious illness was reported last week, died at her home in San Pedro, California, Friday, December 10th, at the age of forty-six years.  The A. E. Rutherford family here were notified by telegram, which, however, gave no particulars.  Mrs. Rutherford was Daisy Henshaw, daughter of John Henshaw, who lives near Payette.  She lived most of her life in the vacinity of Payette and Ontario, and several Ontario people were her schoolmates.  Her immediate family were with her at her death.  They are, her husband, Ben Rutherford, and a son and daughter, John Rutherford, and Mrs. Paul McKee.  She was a member of Ontario Rebekah Lodge, and was always active in the lodge work.  -- Ontario Argus.

Ben was shown in the 1930 census (Apr 4-5 1930), living alone in Yorba Linda, Orange County, California:14
