William Hinshaw prepared his will on the day of his death in 1807:18
William failed to mention two of his children in his will: Alice (perhaps because she had died before this date) and Lucinda, who was not yet born (she was born three months after William died). Notice that William wrote his will with provisions for the expected new baby (Lucinda).
"Whereas I William Hinshaw of Lost Creek in Jefferson County & State of Tennessee being weak of body but of sound mind and memory Do make and ordain this as my Last Will and Testament. First I commend my Soul to God who gave it and my Body to the Earth to be decently buried at the discretion of my Friends & Relatives. And as to such worldly possessions and Treasure as it has pleased kind providence to bless me with it is my Will that the same shall be disposed of after my decease in manner following: First it is my Will that all my Just debts, if any, should be paid by my Executors as soon as can be conveniently be done after my decease. Secondly It is my Will that my beloved wife Margaret Hinshaw should have the whole & sole use of all my Estate both Real & personal during her Widowhood for the purpose of her own support and for the support bringing up & Education of our Children. And in case she should marry again, it is my Will that she should then only have an Equal part with one of the Children of the movable property.
Item. I give and Bequeath unto my son Uriah one third part of my land to be taken off at the Lower end of the place whereon I now dwell. Item. I give and Bequeath unto my Son Ezra One third part of my land joining to Uriah's. Item. I give & Bequeath unto my son William one third part of my Land at the upper end Joining Ezra's. And in case I should have another Son born after this date my will is that he should have an equal share of Lands with my aforenamed three sons of the place whereon I now dwell that is one fourth part each.And lastly I ordain Constitute & appoint my Son Uriah Hinshaw and my Friend Isaac Hammer Executors to this my last Will & Testament in Witness whereof I have hereunto set my hand & Seal this 29th day of the 6th Mo. 1807.Item. I give and Bequeath unto my three sons Uriah, Ezra, and William & my five Daughters namely Sarah Lee, Hannah, Mary, Ruth, & Margaret Hinshaw all my movable property each of them to have an equal part thereof at the marriage or decease of their Mother. And in case I should have another Child born after this date whether son or daughter he or she to have an equal share with one of them. And whereof I expect to have more Land than what is already mentioned in this Will not yet obtained, which if it should be my Will is that it should be sold to the best advantage & the money arising from the Sale thereof among all my children to be equally divided part and part alike.
