From the Sharp County (Arkansas) "Register" January 4, 1878:3
A Negro named Bill Shaver was shot in the neck and shoulder one day last week, with a shot gun in the hands of Jesse Hinshaw. The shooting is said to have been accidental, Hinshaw pointing the gun at the Negro and "snapping" it, through sport, without any knowledge of its being loaded. The wound is a painful but not serious one.
From the Sharp County (Arkansas) "Register" June 7, 1878:3
We neglected to mention the fishing excursion, by Dr. King, D.N. Huddleston, Jesse Hinshaw and others, to Spring River a few days since. They report an agreeable time, and the capturing of plenty of fish, among which was a buffalo weighing twenty-odd pounds.
Jesse was sent to prison for killing a man in Sharp County, Arkansas.3 From the Sharp County (Arkansas) "Register" July 27, 1878:3
FATAL TRAGEDY
It becomes our duty, as a faithful chronicler of passing events, to record a tragical circumstance which took place in our town on Friday evening last, in which James R. Pierce, a young man about twenty-five years of age, lost his life. At the time above stated, a difficulty arose between Jesse Hinshaw and the said James R. Pierce, in Dr. Brown's drug store, where Pierce was employed as clerk. The difficulty arose from a dispute between the two parties over some frivolous matter which led to blows. Pierce first throwing a weight at Hinshaw, and afterward forcing him from the room. Hinshaw then went to the blacksmith shop where he had been employed, procured a gun, and returned to the street some fifty yards from where the difficulty arose, saying he would kill Pierce. He was met by his brother, who endeavored to take the gun from him, but without avail. By this time Pierce came out upon the sidewalk, with a two-pound weight in his pocket, and, according to the testimony of parties present, requested them to let Hinshaw come, that he was fixed for him. Mr. Carroll Shaver then approached Hinshaw, took hold of the gun, and requested him to desist. Pierce then ran down the sidewalk to within about twenty feet of Hinshaw, and trew a weight at him. Simultanious with the throwing of the weight, Mr Shaver, fearing bodily injury, stepped aside, when Hinshaw drew up the gun and shot Pierce dead. The bullet entering his forehead and passing thro' to the back part of the head, and lodging against the skull. This is the sum and substance of the matter, as given on oath by those present at the time of the fatal difficulty.
Immediately after the shooting, Hinshaw fled, pursued by a number of persons, who failed to overtake him, but on the following day he was arrested by Sherriff Huddleston and others, where he was concealed in the woods but a short distance from town. He was brought here and had an examination before Justice Shanks, commencing Monday last, the trial closing on Wednesday, when he was adjudged "guilty of homicide not justifiable," and held to bond in the sum of two thousand dollars, in default of which he was taken to Batesville and lodged in jail, to await the action of the next grand jury -- the jail at this place being deemed insecure.
In connection with the above, it is but justice to the peaceful and law-abiding citizens of this community to state that neither of the parties engaged in this tragedy was a permanent citizen of our town. Hinshaw, single and about twenty-five years of age, had been here about six months, and was employed as a blacksmith by his brother, Mr. J.B. Hinshaw. Pierce came here from Benton county, Tennessee, about three months ago, and was employed as a clerk in Dr. Brown's drug store. Each, so far as we have learned, hath borne a good reputation previous to the above difficulty, and both were members of the United Friends of Temperance.
In the issue of the Sharp County "Register" dated Feb 6 1879 we find what became of Jesse:3
In the case of the state against Jesse Hinshaw, charged with murder in the second degree, tried at a special term of the Independence county circuit court, the jury last Monday returned a verdict of guilty, and the defendant was sentenced to a term of eight years in the penitentiary.
