Born 1795, Surry County, North Carolina.1,8 The wife of Benjamin's son Nathan always told her children and grandchildren that the family was from Orange County, North Carolina.9
He married Sarah A. Vestal, Nov 10 1812, Surry County, North Carolina.1,6,10,11 Sarah was born about 17921,3 [about 17945, about 179612,13], Surry County, North Carolina1,3.
A marriage bond was recorded for Benjamia Hinshaw & Sarah Vestal on Nov 10 1812, Surry County, North Carolina. The bondsman was recorded as Jonathan Hinshaw14,15 (possibly Johathan Hinshaw #1035 or Jonathan Hinshaw #4535).16
It appears that Benjamin moved to Missouri sometime before 1840. Benjamin Henshaw was shown in the 1840 census, Jackson County, Missouri (page 79):17,18
On Nov 10 1841, a Benjamin Hinshaw purchased 81.375 acres of land in Howard County, Missouri.19 He was described as "Benjamin Hinshaw of Howard County, Missouri".19 (There is some doubt if the above was this same Benjamin Hinshaw or a different Benjamin Hinshaw).
On May 1 1843 Benjamin purchased 40 acres of land in Jackson County, Missouri.19 He was described in this record as "Benjamin Hinshaw of Jackson County, Missouri".19
Benjamin Hinshaw was shown in the 1848 Tax List of Cass County, Missouri.20
On Jan 1 1849 Benjamin purchased 160 acres of land in Cass County, Missouri.19 He was described in this record as "Benjamin Hinshaw of Van Buren County, Missouri".19 (Van Buren County was renamed to Cass County in 1849). About this same time, sons Thomas and Nathan also purchased land in Cass County, Missouri.19
Benjamin Hinshaw died 1849, Jackson County, Missouri; age 55 years.1,8,21
Benjamin and Sarah's son Thomas, who died in 1847, is buried next to Benjamin in the same cemetery.22
On Oct 6 1849 Benjamin's will was recorded in court in Cass County, Missouri, and a John M. Armstrong was appointed executor23 (see scan below).

Widow Sarah was shown in the 1860 census (Sep 11 1860), living in the household of daughter Hannah in Big Creek Township, Cass County, Missouri:5
Widow Sarah was shown in the 1870 census (Jun 18 1870), living in the household of daughter Hannah in Pleasant Hill, Cass County, Missouri:13
Sarah died in Cass County, Missouri and is buried in Reed Cemetery, near Harrisonville, Cass County, Missouri.1,27

There is evidence indicating he might have been the same as Benjamin Hinshaw #4536, son of Jacob Hinshaw & Nancy Ann Clanton:
- This Benjamin was born and married in Surry County, North Carolina; the family of Benjamin Hinshaw #4536 was known to have been living in Surry County.
- The marriage bond for Benjamin Hinshaw & Sarah Vestal shows the recorded bondsman was an unidentified Jonathan Hinshaw. Benjamin Hinshaw #4536 had a brother named Jonathan.
- This Benjamin married Sarah Vestal; Benjamin Hinshaw #4536 had a brother Eli who married a Phebe Vestal, and his aunt Mary Hinshaw married a Thomas Vestal.
- This Benjamin moved to Missouri; Benjamin Hinshaw #4536 had a brother Eli whose son Levi was known to have been in Missouri, and also brother Jonathan who appears to be Jonathan Hinshaw #8055 who was known to have been in Missouri.
However there is also some evidence supporting the idea that he might have been Benjamin Hinshaw #96, son of Jesse Hinshaw & Mary Marshall. This Benjamin was born in 1795; Benjamin #96 was also born in 1795. Furthermore, there is the following evidence from family oral history, as first told by Benjamin's daughter-in-law Mary G. Sloan Hinshaw to her grandson Nathan Houser Hinshaw:9
However there are records of Benjamin #96 in North Carolina; some of these records occur in Chatham County, very close in time to when Sarah Vestal Hinshaw's children were being born in Surry County. This adds further doubt.
- Mary G. Sloan Hinshaw told that Benjamin's mother died when he was 12 years old, and his father remarried; the mother of Benjamin #96 died in 1806 when he was 11 years old and his father remarried.
- Mary said that when Benjamin came to Missouri, he had a brother named Jacob who also came with them and then went on to Texas in the 1850's; Benjamin #96 did indeed have a brother named Jacob.
- Mary also said that when Benjamin and Jacob moved to Missouri, they had either one or two brothers who moved to Indiana at that same time; Benjamin #96 did indeed have brothers Jesse who moved to Parke County, Indiana, and Isaac who settled in Wayne County, Indiana. She also said that another Cousin came to visit them who had moved to Illinois back in the 1840's.
- Mary reported that at one time either a brother or an uncle of Benjamin, a Methodist preacher, came to visit the family in Missouri; Benjamin #96 did indeed have a brother John who was a Methodist preacher.
- Mary told that the visiting Methodist preacher said that Benjamin's father had been "kicked out of the Quaker Church"; the father of Benjamin #96 was indeed disowned in 1809.
